Terms of Use

We may modify these terms or any additional terms that apply to a service e.g to reflect changes to the law. We recommend that you look at these terms regularly. When changes go occur we will post notifications of those changes here. Changes will not apply retrospectively and will become effective fourteen days after they are posted. However, changes made for legal reasons will be made effective immediately and changes to address new services we offer. Furthermore, mirror edits for clarification, grammer, etc. will also come into effect immediately. If you do not agree to the modified terms for a service, you can discontinue your use of our service.

Privacy

We do not sell your information to outside parties. However, to offer some of our services, can and will, involve sharing information with third parties. For example, publishers will require identification information to access their services. We endeavour to limit the amount of information that is passed to these third parties at all times.

Use of Third Party Services or Goods

Some services are provided through third parties. When access these goods or services you must abide by their terms of use. Violation of the third parties terms of use might result in us being asked or forced to remove your access to those services through us. Such action will result in your loss of access without refund. Using our services does not give you ownership of any intellectual property rights of the content that you access. You must check with the third party providers to clear intellectual property rights with them.

Use of Services

Do not misuse our services. You may only use our services as permitted by law, including applicable export and control laws and regulations. Illegal actions will result in your loss of access without refund. We may suspend services to you if we are investigating suspected misconduct. These terms do not grant you the right to use any of our branding or logos. If it turns out that a particular term is not enforceable, this will not affect any other terms.

Our Warranties and Disclaimers

We provide our services using a reasonable level of skill and care. However, we cannot make promises about our services. We do not make any commitments about the content within the services. While we will use reasonable efforts to provide continuous availability we cannot guarantee the reliability, availability or ability of our services. We provide our services “as is”. Landward LLC will not be liable, and will not hold Landward LLC liable for any loss, injury, claim, liability, damages, costs, and/or attorneys fees of any kind that result from the unavailability of the Landward LLC. Platform or Content, delays or interruption of the services provided hereunder, or arising out of or in connection with the users use of Landward LLC services. Some jurisdictions provide for certain warranties. To the extent permitted by law, we exclude all warranties.

Force Majeure

Neither Landward LLC nor users will be liable for failures or delays in performing their obligations from any cause beyond their control, including but not limited to, act of God, acts of civil or military authority, terrorism, strikes, lockouts or labour disputes, epidemics, wars, earthquakes, storms, typhoons, riots, fires, and floods and in the event of any such delay, the time for either party’s performance will be extended for a period equal to the time lost by reason of the delay. If the conditions giving rise to the delay continue beyond sixty (60) consecutive days, either party may terminate its agreement with the other by giving written notice to the other party.

Jurisdiction

The courts in some countries will not apply New Mexico law to some types of disputes. If you reside in one of those countries your country’s laws will apply to such disputes related to these terms. Otherwise, you agree that the laws of New Mexico, USA will apply to any disputes arising out of or relating to ours terms or the services. All claims arising out of or relating to these terms or the services will be litigated exclusively in the federal or state courts of New Mexico, USA.
